When preparation support should give way to legal advice
Recognise employment events in Germany that call for prompt advice from a qualified lawyer or trade union.
Preparation support can clarify facts and improve a handover. It cannot replace representation where rights, deadlines, pleadings, negotiation, or litigation strategy are at stake.
Act promptly on formal documents
A dismissal, warning, settlement agreement, demand, hearing notice, works council procedure, or agency letter can trigger consequences or require a response. German employment disputes may involve short time limits. Do not wait for a general consultation if a deadline could be running.
Seek a Rechtsanwalt or union adviser when
- you need a binding assessment of legal claims or prospects;
- you want someone to communicate or negotiate on your behalf;
- court, conciliation, or formal complaint proceedings are contemplated or underway;
- you have been asked to sign a termination or settlement document;
- retaliation, safety, immigration status, or loss of income creates immediate risk; or
- the other side is already represented.
Make the referral efficient
Prepare a one-page chronology, employment contract, the formal document at issue, key correspondence, and a short list of questions. Identify the exact date you received each item. Tell the adviser about every known deadline, even if you are unsure whether it applies.
